2¶If a thief be found 1breaking up, and be smitten that he die, 2there shall no blood be shed for him.

1 As Mat. 24:43. Hebr. in the digging through, or, with a burglarizing instrument.

2 Hebr. it shall be no bloods, that is, to him, (namely, who killed the thief) it shall not be imputed; he shall not answer, nor suffer for it, as if he had committed a murder. Thus the word blood is taken, Num. 35:27, and elsewhere.

33If the sun be risen 4upon him, there shall be blood shed for 5him; for he should make 6full restitution; if he have nothing, then he shall be sold for his theft.

3 That is, if it be bright daylight when the thief is breaking in, whosoever kills him then, his blood must be shed again.

4 Namely, over the thief when he was beaten.

5 Namely, who killed him.

6 Hebr. restoring restore; He, namely, the thief mentioned in verse 1, whose case is prosecuted here.

4If the theft be 7certainly found 8in his hand alive, 9whether it be ox, or ass, or sheep; he shall restore double.

13 That is, any kind of household furniture.

8If the thief be not found, then the master of the house shall be brought unto the 14judges, to see 15whether he have put his hand unto his neighbour's goods.

14 That is, the magistrates, as Exod. 21:6.

15 Understand, to search it out.

9For all manner of trespass, whether it be for ox, for ass, for sheep, for raiment, or for any manner of lost thing, 16which another challengeth to be his, the cause of 17both parties shall come before the judges; and whom the judges shall condemn, he shall pay double unto his neighbour.

20 That is, the oath, whereby the Lord is called upon as Witness.

15But if the owner thereof be with it, he shall not make it good: 27if it be an hired thing, it came for his hire.

27 The sense is: he who has hired it ought to be free to pay the conditioned hire.

28¶Thou shalt not revile 45the gods, nor curse the rulerj of thy people.
